Taking possession without OC is such a legal grey area, it's infuriating. Just got my flat in NBC Shrirang Park from Shrinivas Developers Pune, but the Occupancy Certificate is still pending. They pushed for possession. What are the actual risks here? Can we legally challenge taking possession without OC, or does RERA offer any real protection for this specific issue?

It's a tough spot you're in, OP. Builders often try to push the envelope. Given the '0 projects' history, I'd be extra cautious. What are your next steps? Are you considering legal action?
My parents booked a flat near Anand Nagar years ago, and the builder promised OC within 6 months of possession. It took them almost 3 years! We had to pay higher property taxes and faced issues getting some services. This Shrinivas Developers with '0 projects' sounds even riskier. It's so frustrating how builders play with our hard-earned money and dreams.
Okay, answering the question about actual risks of taking possession without OC. First, legally, it's considered an incomplete building. You might get temporary water/electricity, but permanent connections won't be issued. Second, property tax will be higher as it's not a 'completed' structure. Third, resale is a nightmare; no one wants to buy a property without OC, and banks won't finance it. Fourth, you're exposing yourself to potential demolition orders if the builder deviated from approved plans. In the current Pune market, where buyers are already cautious, a property without OC is almost unsellable. Don't do it unless you have a rock-solid agreement with penalties for the builder.
Haan yaar, this OC issue is a nightmare for first-time buyers like us. A colleague of mine bought a flat in Amanora Park Town, and her home loan disbursal got stuck for ages because the OC was pending. The bank just refused to release the final tranche without it. It adds so much unnecessary stress to an already stressful process.
But seriously, agar le bhi liya possession without OC, what are the *actual* long-term risks? Legal hassles, resale value, property tax ka kya scene hai? Koi batao please.
Exactly! Banks are super strict about the OC. No OC, no full loan disbursal. Plain and simple.
Bhai, you're not alone! NBC Shrirang Park, Shrinivas Developers, right? I heard about them. The fact that they have 'Total projects: 0' on record is a massive red flag. Pushing for possession without OC is such a builder trick to save on holding costs and avoid RERA penalties. My biggest fear is getting stuck with a property that's legally incomplete. What are the *actual* risks if we take possession without OC? Can RERA really help us here, or is it just another paper tiger?
OP, RERA does offer protection for this specific issue, but you need to be proactive. Under RERA, the builder is liable for not obtaining the OC within the stipulated time. You can file a complaint with the MahaRERA authority. They can impose heavy penalties on the builder, sometimes even daily fines, until the OC is secured. Make sure you have all communication records where they pushed for possession without OC. Check their project registration on the RERA portal for any updates.
Yeh toh common tactic hai builders ka. Don't fall for it, it's a trap!
Totally agree with your point about the risks. My friend had a similar issue in Akurdi, builder kept delaying the OC for months after handing over keys. They were so scared about legal complications down the line. It's like they hold you hostage with your own money.
