Checking builder legal history is harder than buying property itself
Checking builder legal history in Bengaluru feels harder than actually finding the right property, no? I'm currently in a 2BHK in Electronic City, thinking of upgrading to a 3BHK or villa around Sarjapur Road. My budget is around ₹1.8 Cr. We saw Windsor Builders' TG Heritage project, but then heard about their past delays. How do you guys *actually* verify a builder ka track record beyond just the RERA number? Is only checking the RERA site enough, or do we need to dig into their past cases and court records? Especially with delayed OC, not sure if getting possession without it is risky. What specific documents should we insist on for proper title verification? Already have a home loan, so can't afford any legal headaches again. Any red flags with RERA registrations that are often missed?

You hit the nail on the head – RERA is definitely not enough. For Windsor Builders specifically, the fact that their 'total projects' is zero on RERA is a massive red flag. This means they either haven't completed any or are very new, which is risky for a project of this scale. Beyond RERA, you absolutely need to check court records. Look up cases in consumer forums, NCLT (for insolvency), and even local civil courts using the builder's name and director names. A good property lawyer is worth their weight in gold here. Also, ask for the project's commencement certificate and approved building plans from the local authority (BBMP/BDA). Possession without OC is highly risky – you won't get water/electricity connections easily and can face penalties.
Court records kaise check karte hain, can you elaborate? Is it online or do we need to physically go somewhere?
My personal experience has taught me RERA is a starting point, not the finish line. I got burned with a project near Adigara Kallahalli. The builder had a RERA number, but they had multiple FIRs against them for previous projects, which I only found out much later through a local lawyer. They just kept dragging the project, citing 'market conditions' and 'material shortages.' Ended up selling that flat at a loss just to cut my losses. Now, for title verification, always insist on the mother deed, Khata documents, property tax receipts, and the builder's approval plan from BBMP/BDA. Don't skip these, ever.
Totally feel you, bhai! This whole builder background check is a nightmare. We were looking at a project near Aavalahalli by Windsor Builders too, for a 3BHK. The sales guy was all smooth talk, but then we heard about their TG Heritage project's massive delays. Makes you wonder if RERA is just for show sometimes, right? How do you even trust anyone these days?
Exactly! My cousin booked with another builder in Akshayanagar and faced a similar issue with OC. Got possession but now can't even get the Occupancy Certificate for months. It's like buying a car without a registration certificate. What's the point of RERA if these things keep happening?
Haan yaar, same pinch! That Windsor name itself gives me jitters. Heard they have zero completed projects listed anywhere. Big red flag for me.
