My lease ends in 4 months and I still haven't figured this out. I work in real estate but buying my own ATS project in Sector 150 has been a nightmare. Construction-linked plan is draining me with delays. Builders don't tell you this. Are others stuck paying EMIs for delayed projects too?

Overall, the problem is systemic. Builders know they can get away with delays because the legal process is slow and buyers are desperate. The only way to truly protect yourself is to buy from builders with a 100% clean delivery record, which are very few, or go for ready-to-move properties. Don't fall for fancy brochures and 'pre-launch' discounts.

I must be lucky then. My project in Sector 121 by a mid-sized builder actually delivered 3 months before the RERA deadline. It does happen, but it's rare. I think I just chose the right time and the right project manager. Don't lose hope completely, but be prepared for the worst.
So the bottom line is, even with big names like ATS and in prime areas like Sector 150, builder delays are a harsh reality. For first-time buyers and those on CLPs, it's a financial and emotional nightmare. The market might be good, but possession is king. OP, let us know what you decide to do about your lease!
@U10 Honestly, I did my due diligence on ATS's reputation, not necessarily their specific project timelines for every single phase. My mistake was assuming a big brand would be more disciplined. The sales pitch was too good to ignore, I guess. Lesson learned the hard way.
@U3 It's ATS Pious Hideways. They initially gave a possession date of Dec 2022, then it became June 2023, now it's Dec 2024. And looking at the construction, even that seems ambitious. My lease ends in 4 months, I can't keep extending it.

@U3 Written commitment? Lol, builder usually gives a vague letter saying 'due to unforeseen circumstances'. Penalty toh agreement mein ₹5/sqft per month likha hai, which doesn't even cover my maintenance charges, let alone EMI or rent.
@U4 Exactly! That penalty clause is a scam. It's always disproportionate to the actual loss. You should form a buyer's association for your project and collectively put pressure. That's the only way sometimes.
This whole CLP vs. Subvention vs. Down Payment plan debate is crucial. CLP is better than subvention in some ways as you're not paying interest before construction, but the delay risk is paramount. Ready-to-move always takes the cake if you have the funds.
Sector 150 has seen massive appreciation in rates, but the delays are a big concern. Currently, rates are hovering around ₹6800-₹7500/sqft for under-construction projects. A lot of new infrastructure coming up, like the FNG corridor and proposed metro extension, but if you don't get possession, what's the point of appreciation?

@U16 Absolutely go for ready-to-move. Mera experience hai, under-construction mein bahut headache hai. You save on GST, get immediate possession, and no risk of rent+EMI. Thoda extra paisa lagega but worth it. Noida Extension mein bahut options hain ab.
What kind of legal recourse have people actually taken beyond RERA? Has anyone successfully taken a builder to consumer court or initiated arbitration? I'm at my wit's end with my builder in Greater Noida West and thinking of exploring all options.
Builder ne phir se date extend kar diya lol. This is the 5th time for my project in Sector 168. Ab toh lagta hai mere bachche bade ho jayenge tab jaake ghar milega. Matlab builders ko koi fark nahi padta, they just keep pushing. It's a joke!

RERA date toh kab ki nikal gayi, they just filed for extension. Builder ka track record dekh ke hi lena chahiye, warna yahi hota hai.

Bhai, this is too real! I feel your pain. CLP mein sabse bada catch yahi hai. Builders promise the moon and deliver dust. Mera bhi Sector 78 mein same haal hai, 3 saal ho gaye, abhi tak possession nahi mila. Double burden, rent aur EMI dono. Total financial drain.
Totally agree yaar! ATS 150 ka toh track record bhi itna acha nahi hai delays ke liye. Especially after COVID, sab builders ne deadlines ko joke bana diya hai. Meri ek friend hai, uska bhi ATS project phase 2 mein hai, same problem. Builder ke paas koi solid answer hi nahi hota.
