posted on 9 MayUpgrading for family: legal worries
Did a site visit to Nimi Symbolic Homes on Saturday, good location in Noida Extension for my family's 3BHK requirement. Kids' school and safety are top priority. But I'm really worried about legal issues. Builder ka track record kaise check karein properly? I mean, RERA registration toh dikha dete hain, but usmein kya red flags ho sakte hain? Aur agar construction delay hota hai, toh RERA ke under real options kya hain? Builder-buyer agreement mein kaunse clauses dhyaan se padhne chahiye jo sirf builder ko favour karte hain? Koi experience share karega ya advice dega?

It's a tough market right now, especially with interest rates fluctuating and construction costs rising. Builders are under pressure, which can sometimes lead to cutting corners or delays. For Nimi Symbolic Homes, research RN Homes' past projects thoroughly. Talk to people who have bought from them already. Don't just rely on online reviews; visit their completed projects and talk to residents there. The builder-buyer agreement is key – focus on clauses about delay penalties, quality of construction, and maintenance charges. Noida Extension has a lot of inventory, so take your time.
Haan bhai, RERA registration toh sab dikha dete hain. But what are the actual red flags to look for *within* the RERA details itself?
Good question! In RERA, check the project's 'Quarterly Updates' section. Agar updates irregular hain, ya construction progress bahut slow dikh raha hai, that's a red flag. Also, look at the 'Litigation Details' for any past cases. And, if the project completion date has been revised multiple times without proper justification, be very wary. RN Homes' past projects often show these patterns.
My personal experience with a builder (not RN Homes, thankfully) was a nightmare regarding construction delay. They kept pushing the date, and the RERA penalty clause in the agreement was so diluted, it barely covered our rent. We ended up paying EMI and rent for an extra year. Builder-buyer agreements are usually heavily skewed towards the builder. Look for clauses about force majeure, compensation for delays, and exit options. Also, check if they mention any specific date for obtaining the occupancy certificate. Builders often use vague language to protect themselves. Don't sign anything without a lawyer reviewing it.
Exactly! Which specific clauses should we be extra careful about in the builder-buyer agreement? Koi examples de sakte ho jo sirf builder ko favor karte hain?
Uff, this is my biggest fear! Paying both EMI and rent sounds like hell.
Your concern about RN Homes' track record is valid. RERA registration is crucial, but it's not a magic bullet. For builders like RN Homes, you need to check their past projects. Have they delivered on time? Any legal cases against them? There are specific RERA sections where you can see complaints filed. Don't just look at the registration, delve into the project details and complaint history on the RERA portal.
Yes, I can confirm this. My friend had a terrible experience with an RN Homes project in Ajayabpur. They promised possession in 2021, but it's 2024, and the project is still incomplete. RERA mein complaint bhi daali thi, but resolution process is so slow. Abhi bhi wait kar rahe hain. Their builder-buyer agreement had a clause that allowed them to delay for 'unforeseen circumstances' with minimal penalty. It felt like a trap. Definitely check the RERA portal for the project status and any past violations for RN Homes.
Can you give some more specifics about RN Homes? Kya issues hain unke past projects mein? Any specific project names to look out for?
Bhai, you've hit the nail on the head! Exactly my fear. Nimi Symbolic Homes sounds good on paper, but after seeing so many projects get stuck, RERA registration feels like just a formality sometimes. My cousin booked a flat near Alpha I Greater Noida, RERA registered project tha, but builder ne delivery date 2 saal extend kar di. Uska poora budget hil gaya. How do we really know if a builder like RN Homes is trustworthy beyond just the RERA number? It's such a huge investment, and the thought of construction delays or hidden clauses just gives me sleepless nights. Kids' future is at stake.
Totally agree with you! Builder ki reputation check karna sabse mushkil hai. Sirf RERA pe bharosa karna risky hai.
